On August 21 that year, the US Court of Appeals for the District of Columbia overturned the Cross-State Air Pollution Rule (CSAPR) – a rule that would have required US states to set up cap-and-trade schemes for controlling power plant emissions. The US Environmental Protection Agency (EPA) had been working to implement the rule since the Clean Air Interstate Rule was rejected by the same court in 2008
