Why did self-regulation fail?

The Associations' agreements underlying the system of negotiated third-party access constituted a compromise that was weak from the outset. The players involved were not really interested in achieving the objectives laid down. Hence negotiated third-party access - despite some useful approaches - never really had a chance to lead to market opening and effective competition.
